Prior to entering into marriage or civil partnership parties may wish to regulate their property and financial affairs in the event of their separation.

In 2010 the Supreme Court recognised the validity of such agreements. They are still not legally binding on the parties to the agreement but in appropriate cases may be a decisive factor in the decision of the Court.

Since the 2010 decision of Radmacher v Grantino the number of cases before the Courts involving such agreements has increased dramatically.

The Law Commision is due to report on whether such agreements should be legally recognised by the end of 2013.
