Understanding the law in relation to Divorce
The only ground for divorce is that the marriage has irretrievably broken down.
This can be based on one or more of the following;
- Adultery
- Unreasonable behaviour
- Desertion for at least 2 years
- Separation for 2 years where both parties agree
- Separation for 5 years where there is no agreement
Often obtaining a divorce is a paper exercise and does not involve attending Court.
However if one party disputes the petition and wishes to contest the divorce the Court will have to make a decision about the alleged facts.
